Bluetooth Amber Terms of Use

PLEASE READ THESE BLUETOOTH AMBER TERMS OF USE (“Bluetooth Amber Terms”) CAREFULLY BEFORE ACCESSING OR USING BLUETOOTH AMBER (Bluetooth Amber may be referred herein as the “Tool” or the “Service”). These Terms are a legal agreement between you and Bluetooth SIG, Inc., a Delaware Corporation (“Bluetooth SIG”) that governs your access to and use of Bluetooth Amber. References to “you” and “your” mean any person or legal entity that visits, accesses, or uses Bluetooth Amber. BY ACCESSING OR USING THE SERVICES, LOGGING IN WITH YOUR USER ACCOUNT, ENTERING A QUERY, AND/OR CLICKING “I AGREE” OR “CONTINUE,” YOU (THE INDIVIDUAL CLICKING “I AGREE” OR “CONTINUE”) REPRESENT THAT YOU ARE AUTHORIZED TO BIND YOURSELF AND THE ENTITY LISTED IN THE ACCOUNT REGISTRATION (“Your Member Company”) AND THAT YOU AND THAT ENTITY AGREE TO BE BOUND BY THESE TERMS. IF YOU ARE NOT AUTHORIZED OR DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE SERVICE OR CLICK TO INDICATE THAT YOU AGREE TO THESE TERMS.

1. SIG MEMBERSHIP TERMS AND TERMS OF USE. If you are a user with an Account issued under the account of a Bluetooth SIG member you agree that the “SIG Member Terms” which include the Bluetooth SIG Membership Commitment Agreement or Promoter Membership Agreement; Bluetooth SIG’s Certificate of Incorporation and Bylaws; the Bluetooth Patent/Copyright License Agreement and Bluetooth Trademark License Agreement; and all policies and rules adopted by Bluetooth SIG’s Board of Directors and any individual or group authorized by Bluetooth SIG’s Board of Directors in accordance with Bluetooth SIG’s Bylaws, and the “SIG Terms of Use” which include the Terms of Use and any Additional Terms as defined therein, all of which may be modified from time to time, also apply to your use of the Service. If there is a conflict between these Bluetooth Amber Terms and any SIG Member Terms or SIG Terms of Use, these Bluetooth Amber Terms will govern.
2. ELIGIBILITY. The Service is available only to users who have been granted access by the Bluetooth SIG. You represent and warrant that: you will not share your access credentials or permit unauthorized users to access the Service; you will use the Service only for lawful purposes and in compliance with these Bluetooth Amber Terms and all applicable laws and regulations; you will promptly notify Bluetooth SIG of any unauthorized use of or access to the Service; and you are at least 18 years of age or the age of legal majority in your jurisdiction, whichever is higher. You and your Member Company (as defined in the SIG Member Terms) agree that Bluetooth SIG may attribute all use of the Service to you and that you and your Member Company are responsible for all activities that occur. Depending on your membership status and other criteria, you may not have full access to all features of the Service and you agree not to attempt to access any restricted features.
3. SERVICE. Bluetooth Amber is a proprietary, internally developed AI-powered assistant operated and maintained by the Bluetooth SIG to help navigate Bluetooth specifications, qualification processes, and related technical resources. The Service is provided for informational, productivity, and research support purposes only and generates responses that may contain errors or omissions. Bluetooth Amber generates responses by retrieving content from Bluetooth SIG specifications, documentation, and related sources available to the Service at the time of your query and may not reflect the most current published sources. You should always independently verify information against official Bluetooth SIG specifications and documentation. Nothing generated by the Service constitutes legal, certification, regulatory, compliance, or other professional advice.
4. LICENSE TO USE. Subject to your compliance with these Bluetooth Amber Terms, Bluetooth SIG grants you, a limited, revocable, worldwide, royalty-free, personal, non-transferable, non-sublicensable, non-exclusive license to use the Service for your internal business purposes.
5. RESTRICTIONS. You agree that when using the Service or Content, you will not engage in or attempt to engage in any Improper Uses (as defined below); nor will you attempt to extract, reverse-engineer, or misuse Bluetooth Amber, the underlying system prompt, model, or data. Improper uses include violating these Bluetooth Amber Terms, any applicable law or regulation, or the Bluetooth SIG Web Site User Code of Conduct; submitting prompts intended to facilitate unauthorized access, cybersecurity exploits, or malicious use of Bluetooth technology including the Service, or prompts designed to bypass safety guidelines or elicit harmful Outputs (as defined below), or unauthorized or confidential information; attempting to extract member-confidential data, unreleased specifications, or internal Bluetooth SIG information, or inputs designed to manipulate, corrupt, or adversely affect the Service; using Bluetooth Amber to generate fraudulent qualification documentation, misinformation, or information intended to deceive, or circumvent SIG processes; prompt Bluetooth Amber to generate responses concerning politics, elections, government policy, race, discrimination of any kind, religion, sexual or obscene content of any kind, violent content of any kind, personal opinions on social or cultural issues, or any similar responses, third-party patent or intellectual property information, generating executable or functional software code. If Bluetooth SIG suspects violations of the restrictions in this Section, Bluetooth SIG may institute legal action and cooperate with law enforcement authorities in bringing legal proceedings against violators. You agree to reasonably cooperate with Bluetooth SIG in investigating suspected violations. You authorize Bluetooth SIG to monitor your activities within the Service and to investigate activities that Bluetooth SIG considers to be illegal or a violation of these Bluetooth Amber Terms.
6. CONTENT AND USE. Subject to the rights granted herein, as between you and Bluetooth SIG, you retain ownership of the content and prompts you submit to the Service ("User Inputs") and the outputs generated specifically in response to your User Inputs ("Outputs"). By using the Service you: 1)represent, and agree that all User Inputs are submitted, voluntarily by you, have the authority necessary to grant the rights in this Section, and that your User Inputs do not infringe the rights of Bluetooth SIG or any third party or violate any SIG Member Terms or any applicable law; 2) acknowledge that Bluetooth SIG does not control and is not responsible for User Inputs of any kind or Outputs generated by the inputs of other users; 3) that if you provide User inputs in or to any other areas or services maintained by Bluetooth SIG, such content may be used by Bluetooth Amber or other users and Bluetooth SIG is not in control of or responsible for such use; and 4) you grant Bluetooth SIG an irrevocable, non-exclusive, royalty-free, worldwide license to use, process, and analyze your User Inputs and Outputs solely for the purpose of improving, training, evaluating, and refining the Service. Bluetooth SIG will exercise the license you grant herein only in an anonymized or aggregated manner that does not identify you as an individual or attribute the data to you specifically. Bluetooth SIG will not sell, license, or otherwise make your User Inputs or Outputs available to third parties for their independent commercial use. If you submit feedback, suggestions, ideas, or recommendations regarding the Service ("Feedback"), Bluetooth SIG may freely use, incorporate, and exploit such Feedback without restriction, compensation, or attribution to you. Bluetooth SIG is under no obligation to post your content in the Service and may, in its discretion, edit, block, refuse to post, or remove any content at any time.
7. DISCLAIMER OF WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE, OUTPUTS, AND FUNCTIONALITY PROVIDED THROUGH OR IN CONNECTION WITH THE SERVICE ARE PROVIDED “AS IS,” “WITH ALL FAULTS” AND “AS AVAILABLE” AND THE ENTIRE RISK OF USE AND PERFORMANCE REMAINS WITH YOU. BLUETOOTH SIG DOES NOT MAKE ANY REPRESENTATIONS, WARRANTIES, OR CONDITIONS, EXPRESS, IMPLIED, OR STATUTORY, AND HEREBY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT (INCLUDING CLAIMS OF COPYRIGHT, TRADEMARK, PATENT, OR TRADE SECRET INFRINGEMENT). IN PARTICULAR, BLUETOOTH SIG, ITS MEMBERS, SUPPLIERS, AND LICENSORS MAKE NO WARRANTY THAT THE SERVICE OR OUTPUTS: (A) WILL MEET YOUR REQUIREMENTS; (B) WILL BE AVAILABLE OR PROVIDED ON AN UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE BASIS, OR BE FREE OF VIRUSES OR HARMFUL COMPONENTS; (C) WILL BE ACCURATE, COMPLETE, OR RELIABLE; (D) WILL NOT CONTAIN ERRORS, OMISSIONS, HALLUCINATIONS OR OUTDATED INFORMATION, OR (E) THAT ANY DEFECTS OR ERRORS THEREIN WILL BE CORRECTED. THE SERVICE AND ALL OUTPUTS YOU OBTAIN THROUGH THE SERVICES IS ACCESSED AT YOUR OWN RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE OR LOSS THAT RESULTS THEREFROM. YOU ACKNOWLEDGE THE INHERENT RISK OF USING MACHINE GENERATED OUTPUTS AND ASSUME FULL RESPONSIBILITY FOR REVIEWING ANY OUTPUTS, ENSURING THAT YOUR USE OF OUTPUTS DOES NOT INFRINGE ON A THIRD-PARTY’S INTELLECTUAL PROPERTY RIGHTS, AND ENSURING YOUR USE OF OUTPUTS MEETS YOUR NEEDS.
8. DISCLAIMER OF CERTAIN DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BLUETOOTH SIG BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT, OR PUNITIVE DAMAGES; FOR LOSS OF PROFITS, BUSINESS, GOODWILL, ANTICIPATED SAVINGS, OR USE; LOSS OR CORRUPTION OF DATA, CONFIDENTIAL INFORMATION, OR OTHER INFORMATION; BUSINESS INTERRUPTION; PERSONAL INJURY; PROPERTY DAMAGE; LOSS OF PRIVACY; FAILURE TO MEET ANY DUTY OF GOOD FAITH OR REASONABLE CARE; NEGLIGENCE; OR ANY OTHER PECUNIARY OR OTHER LOSS WHATSOEVER, ARISING OUT OF, BASED ON, RESULTING FROM, OR IN ANY WAY RELATED TO THESE BLUETOOTH AMBER TERMS, THE SERVICE, OR OUTPUTS, EVEN IF BLUETOOTH SIG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. LIMITATION OF LIABILITY AND EXCLUSIVE REMEDY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND TO THE EXTENT THEY ARE NOT EXCLUDED OR DISCLAIMED UNDER SECTIONS 7 OR 8, BLUETOOTH SIG’S MAXIMUM, AGGREGATE LIABILITY TO YOU, AND YOUR EXCLUSIVE REMEDY UNDER THESE TERMS FOR ANY AND ALL DAMAGES, INJURIES, AND LOSSES ARISING FROM ANY AND ALL CLAIMS AND CAUSES OF ACTION ARISING OUT OF, BASED ON, RESULTING FROM, OR IN ANY WAY RELATED TO THESE BLUETOOTH AMBER TERMS, THE SERVICE, OUTPUTS, OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT WILL BE TO RECOVER THE ACTUAL DAMAGES YOU INCUR BASED UPON REASONABLE RELIANCE ON THE SERVICE UP TO FIVE DOLLARS (U.S. $5.00). THE EXISTENCE OF MULTIPLE CLAIMS OR SUITS UNDER OR RELATED TO THESE TERMS, THE SERVICE OR OUTPUT WILL NOT ENLARGE OR EXTEND THE LIMITATION OF MONEY DAMAGES WHICH WILL BE YOUR SOLE AND EXCLUSIVE REMEDY.
10. INDEPENDENT REMEDIES. The exclusion of damages under Section 8 is independent of your exclusive remedy in Section 9 and it survives even if the exclusive remedy fails of its essential purpose or otherwise is deemed unenforceable. Each of the limitations of liability in Sections 8 and 9 apply without regard to whether loss, liability, or damage arises from (a) breach of contract, (b) breach of warranty, (c) fault or tort, including negligence and misrepresentation, (d) strict liability, or (e) any other cause of action, to the extent the exclusions and limitations are not prohibited by applicable law.
11. NOTICE ON POTENTIAL LIMITS OF SECTIONS 8, 9, and 10. Some jurisdictions do not allow the exclusion or limitation of damages (including incidental or consequential), loss, or liability from intentional acts (including fraud, fraudulent misrepresentation, and failure to disclose defects), product liability, or for death or personal injury. Nothing in Sections 8, 9, or 10 will be interpreted as excluding liability which cannot under applicable law be excluded in those jurisdictions. If you reside, or are otherwise subject to the laws in one of those jurisdictions any statutory entitlement available to you will be deemed limited to the extent (if at all) permissible under that law and, if limitation is not permitted, the limitations and exclusions in this section may not apply to you.
12. INDEMNIFICATION. 
    1. BLUETOOTH SIG SHALL HAVE NO OBLIGATION TO INDEMNIFY, DEFEND, OR HOLD HARMLESS YOU OR YOUR MEMBER COMPANY FROM OR AGAINST ANY CLAIMS, LOSSES, LIABILITIES, DAMAGES, COSTS, OR EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING OUT OF OR RELATED TO: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) YOUR VIOLATION OF THESE BLUETOOTH AMBER TERMS; (C) YOUR VIOLATION OF ANY THIRD-PARTY RIGHTS; OR (D) ANY OUTPUTS GENERATED BY OR THROUGH THE SERVICE.
    2. You agree to indemnify, defend, and hold harmless Bluetooth SIG, its affiliates, and its respective directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, your violation of these Bluetooth Amber Terms, or your submission of any User Input.
13. CONFIDENTIALITY. You agree to comply with the Bluetooth SIG Confidentiality Policy to the extent it contains Member Confidential Information or SIG Information. DO NOT SUBMIT CONFIDENTIAL, PROPRIETARY, PERSONALLY IDENTIFIABLE, PROTECTED HEALTH, FINANCIAL, OR LEGALLY PRIVILEGED INFORMATION TO THE SERVICE. Bluetooth SIG does not guarantee the confidentiality of User Inputs, and submission of any such information is at your sole risk.
14. PRIVACY. Bluetooth SIG respects and is committed to protecting your privacy. When you use or access the Service, you authorize Bluetooth SIG to automatically collect personal information about you, your use of the Service, and Service performance, and to use, transmit, process, and store that information in accordance with the Bluetooth SIG Privacy Policy, which is incorporated herein by reference. Bluetooth SIG will store your acceptance of these terms, including the date and time, for audit purposes. Bluetooth SIG does not guarantee the privacy of User Inputs, and submission of any such information is at your sole risk.
15. COPYRIGHT AND TRADEMARK NOTICES. You acknowledge and agree that Bluetooth SIG and its members, licensors, and suppliers own all right, title, and interest (including intellectual property rights) in the Service and reserve all rights not expressly granted to you in these Terms or, if applicable, the SIG Member Terms. The Bluetooth logos and word marks referenced in the Service and any Outputs are the trademarks of Bluetooth SIG and its affiliates. Any other company names, product names, service names and logos referenced in connection with the Service or Outputs may be the trademarks of their respective owners.
16. SUPPORT AND AVAILABILITY. Bluetooth SIG has no obligation to and may not provide support in relation to the Service. Bluetooth SIG does not guarantee availability of the Service and your access is permitted only if and when the Service is available. The Service may occasionally be down for service, upgrades, maintenance, or other reasons. Certain features or functionalities of the Service may be pre-release versions and may not work correctly or in the way a final version might work. Bluetooth SIG may significantly change the final version or decide not to release it. To the maximum extent authorized under applicable law, Bluetooth SIG reserves the right to discontinue your access to the Service, or to any content provided or made available to you through use of the Service at any time without notice to you.
17. CHANGES TO THESE TERMS. Bluetooth SIG reserves the right to change these Bluetooth Amber Terms at any time. Bluetooth SIG may give notice by making the updated Bluetooth Amber Terms available through the Service or by any other reasonable means. You can view the most current version of the Bluetooth Amber Terms at any time at amber.bluetooth.com/terms-of-use. The updated Terms are binding on you as of the Effective Date indicated therein. If you do not agree to the updated Bluetooth Amber Terms, you must stop using the Service before the effective date. Your continued use of the Service after the effective date will constitute your acceptance of the updated Bluetooth Amber Terms.
18. THIRD PARTY WEBSITES AND LINKS. The Service and Output may contain links or references to third party web sites (“Linked Sites”). Bluetooth SIG does not endorse or sponsor any Linked Sites or the information, products, or services contained on any Linked Sites. Bluetooth SIG has no control over Linked Sites or their content. Linked Sites are governed by their own terms of use and privacy policies.
19. THIRD PARTY PRODUCTS AND SERVICES. The Service may enable you to access and use services or tools provided by third parties (“Third Party Services”). You may be able to log into Third Party Services with your Account or you may need to obtain and use separate credentials provided by the Third Party Services provider. You agree that you may only use Third Party Services in connection with your participation with the Bluetooth SIG and that your use is subject to these Bluetooth Amber Terms, SIG Member Terms, SIG Terms of Use, any service specific terms located at https://www.bluetooth.com/terms-of-use/third-party-service-terms/, and any terms and policies of the Third Party Service provider, including those regarding collection, use, and sharing of data (“Third Party Terms”). By using the Third Party Services you agree to the Third Party Terms and that you will comply with them. Bluetooth SIG may suspend or terminate your access to Third Party Services at any time without notice to you. In addition, you may need to use or obtain additional products or services in order to use the Services or Content, such as internet access, a device, or a data connection and those products and services may require additional fees which you will pay. Bluetooth SIG does not endorse or sponsor any third party products or services and does not have control over such products or services. Bluetooth SIG is not responsible for any malfunction or error attributable to your use of a third party product or service.
20. TERMINATION. Bluetooth SIG reserves the right to terminate these Bluetooth Amber Terms, and/or suspend or terminate the Service at any time with or without prior notice. Any Sections reasonably intended to survive termination will survive termination, specifically 4 - 23.
21. NOTICE AND TAKEDOWN PROCEDURES. Bluetooth SIG respects the intellectual property rights of others. If you believe that material available in the Service infringes your copyright or the copyright of any third party, please notify Bluetooth SIG in accordance with the Bluetooth SIG Copyright Policy.
22. GOVERNING LAW AND DISPUTE RESOLUTION. These Terms shall be governed by and construed in accordance with the laws of the State of Washington without reference to its conflict of laws provisions. You agree to submit to the exclusive jurisdiction and venue in the state and federal courts sitting in King County, Washington, United States, for any and all disputes, claims, and actions arising from or in connection with the Service or these Terms.
23. General. Section titles are only for convenience and have no legal or contractual significance. Any list of examples following “including” or “e.g.,” is illustrative and not exhaustive, unless qualified by terms like “only” or “solely.” Where “you” implies “Your Member Company” your Member Company (as defined in SIG Member Terms) shall be bound as if the reference was directly to your Member Company. The Service, Outputs, Bluetooth Amber Terms, and SIG Member Terms or SIG Terms of Use are all provided in English which is the official language used by Bluetooth SIG. Any translations into other languages are provided for convenience only and will have no interpretive effect. If there is a conflict between the English language version and any translation, the English language will prevail. Bluetooth SIG’s failure to act with respect to a breach by you or others does not waive its rights to act with respect to subsequent or similar breaches. A waiver will only be binding on Bluetooth SIG if it is in a written document signed by Bluetooth SIG. If any provision of these Bluetooth Amber Terms is held by a court of competent jurisdiction to be illegal, invalid, or unenforceable, the remaining terms, covenants and restrictions will remain in full force and effect. You, Your Member Company (if applicable), and Bluetooth SIG intend that the provisions of these Bluetooth Amber Terms be enforced to the fullest extent permitted by applicable law. Accordingly, you, Your Member Company (if applicable), and Bluetooth SIG agree that if any provision is deemed unenforceable, where possible, it will be modified to the extent necessary to make it enforceable, which may include its deletion. Bluetooth SIG may assign these Bluetooth Amber Terms, in whole or in part, at any time with or without notice to you or Your Member Company (if applicable). You and Your Member Company (if applicable) may not assign, transfer or sublicense your rights (if any). These Bluetooth Amber Terms will be binding upon Bluetooth SIG’s successors and assigns. These Bluetooth Amber Terms (including any incorporated terms), SIG Member Terms, or SIG Terms of Use provided or presented to you when you access or use certain features of the Service constitutes the entire agreement between you and Your Member Company (if applicable) and Bluetooth SIG with respect to the Service. Both you and Your Member Company (if applicable) and Bluetooth SIG warrant to each other that, in entering this agreement, neither Bluetooth SIG nor you or Your Member Company (if applicable) have relied on nor will have any right or remedy based upon any statement, representation, warranty, or assurance other than those expressly stated in these Bluetooth Amber Terms. The preceding sentence will not limit or exclude any liability that cannot be limited or excluded under applicable law. No one other than you and Bluetooth SIG, or Bluetooth SIG’s successors and assigns, will have any right to enforce these Bluetooth Amber Terms.
24. CONTACT INFORMATION. Bluetooth SIG may give you all notices (including legal process) that Bluetooth SIG is required to give by any lawful method, including by making notice available through the Service or on Bluetooth SIG’s web site located at www.bluetooth.com, or by sending it to any email or mailing address that you provide to Bluetooth SIG. You acknowledge that if you do not provide Bluetooth SIG with current and accurate contact information, Bluetooth SIG may not be able to contact you.
